The Unsecure Fate of H4 Dependent Spouses in USA highlighted by widow of SrinivasKuchibhotla

An Indian man and a friend who were out for a relaxing night in Olathe in Kansas on Feb. 22. SrinivasKuchibhotla and friend were drinking at a bar when they were shot at by a person named Adam Purinton in a racially motivated attack. SrinivasKuchibhotla. While his friend survived his injuries, Kuchibhotla was killed in the attack, leaving behind his young widow SunanyaDumala.

The uncertain Immigration status of Dumala

After the devastating loss of her husband, SunanyaDumala had to face the fact that her own immigration status was now uncertain. Like many other spouses of H1B workers, her visa was connected to her husband’s visa and she was not sure if she would be allowed to return to America after attending her husband’s funeral in India in February. Hearing of her immigration plight, Congressman Kevin Yoder managed to get a one-year employment authorization for her to his office. This one-year authorization would give her sufficient time for applying for an employment visa on her own. Yoder who is from the Republican Party, generally holds strict views on immigration and is against DACA and funding to sanctuary cities, but had made an exception in the case of legal immigrants like SunanyaDumala and her husband.

SunanyaDumala’s predicament not new for Indian Immigrants

The struggles that Dumala faced with her immigration status brings to light an issue that is important for the Indian-American community. She had entered US along with her husband, who came on an H1B visa, which is used by companies in the USA to bring in highly skilled workers from abroad. As the H1B is a dual intent visa, many who arrive in the US on an H1B go on to apply for a green card. However, the waiting period for permanent immigration can be painfully long as there are strict limits on the number of employment-based green cards which can be issued to each country. As a result, applicants from countries with high population rates have longer wait times. Currently, a person from India who applies under the EB2 category can expect a wait time of 10 years on an average for his green card application to be processed. Moreover, the uncertainty of USA H1B Visa Immigrants has a large impact on their spouses, who come to the US under the H4 or dependent visa.
Many of the people who come to the US under H4 Visa are highly educated women who were pursuing successful careers in their home country but are not allowed to work in the US. The DACA program has been in the news a lot lately. With speculations and assertions being made right, left and center, the fate of the Dreamers hangs in balance. After an announcement by Jeff Sessions that the White House under President Trump was rescinding DACA and a decision about the DACA bill would have to be taken by the Congress. The Democratic house speaker Nancy Pelosi stated on 13th September that President Trump assured her that he would support the DACA bill in the congress. Thus increasing hopes that a deal was finally being reached which would allow the DACA bill to be passed by Congress and allow the more than 80000 Dreamers affected by the bill to Live in USA without fear of deportation.

As soon as the news of Nancy Pelosi’s statement came out, there was a host of conflicting statements being belted out by different factions. Immediately following the state House Republicans were quick to state that President Trump did not come to any agreement with Democrats on the DACA program.

Many people believed that an agreement was close to being reached where the GOP would support DACA in return for some form of border security. But on Thursday President Trump sent out a statement through White House Press Secretary, Sarah Huckabee Sanders denying all claims of a deal being made.

Many of them do not know any other country except the USA as they were brought here at a very young age

UK visas that were issued to the three biggest non EEA student populations have also seen increase in visa issuance too. Students from India were granted around 11,700 visas with an increase of almost 10% compared to last year. Students from the US were granted around 14,400 visas.

UK work visas from entire categories that include Tier 1, youth mobility and temporary ones has witnessed slight decline when compared to last year. The Brexit effect has shown few signs with EU citizens migrating out of the UK.

2772 ITAs issued to apply for Canada PR through Express Entry Draw

As many as 2772 applicants has been granted an ITA (Invitation to Apply) in the latest draw of Express Entry that took place yesterday. 

The current draw has witnessed a least CRS (Comprehensive Ranking System) score requirement of 435 points. Hence, those applicants who are in the pool of Express Entry with a score of 435 or more at the time of draw might now apply for the status of Canada Permanent Resident.

The most current draw was not constrained to any one precise program; applicants in all the programs who had managed to get into the Express Entry were in a position of getting an ITA to be entitled. Applicants are initially needed to meet the criteria of one of three Canada immigration programs that are managed through this Express Entry System. And those programs are Federal Skilled Trades Class, Federal Skilled Worker Class or Canada Experience Class.

If we compare this draw results with the current draw, last year draw was held on 23rd August 2017 and Around 3035ITAs were issued with the CRS score of 434 points.

The current draw has seen decrease in the issues of ITAs with only point difference in the CRS score compared to previous draw.

Since January 2017 till now, around 66, 549 ITAs were issued to potential candidates which is more than those issued last year.

Applicants has now got three months to apply for Canada PR with their supporting documents, as IRCC intends to  conclude the application processing within six months.
