A recently conducted review of US government has found that majority of the applications for employer sponsored green cards have come from companies that have their headquarters in the United States. Out of the list of top ten companies APPLYING FOR US IMMIGRATION on behalf of their employees in the last six months, just two companies from India, viz Infosys and Tata Consultancy Services were present.

Technology companies based in USA, such as Cisco, Facebook, Microsoft, Amazon, Cognizant, and Google have between themselves filed more number of applications for green cards for their employees from different countries. A major proportion of the beneficiaries of these employer sponsored GREEN CARDS were Indians. Amazon has filed more than 1,500 applications on behalf of its employees. NASSCOM, (National Association of Software and Services Companies), has said that the report supports its claim that there is a significant shortage of skilled workers in the United States and that companies based in America are hiring more people from countries like India, where they most of the skilled IT talent is available. The responsibility of applying for a green card rests with the individual worker. However, many US based companies apply for an Immigrant Petition for Alien Worker or I-140 in order to retain their highly skilled resources.

The US government under the administration of President of Donald Trump had confirmed in a court filing, the administration’s intention to put in action a proposed rule that aims to revoke the work permits of H1B spouses. These work permits allowed the spouses and dependents of H1B visa holders who came to USA on the H4 visa to work under certain conditions. The visas which were popularly known as H4 EAD, short for H4 Employment Authorization Document, were under intense scrutiny by the Trump administration, with the President himself taking a personal interest in its revokal. The DHS or Department of Homeland Security was working out the fine print and the proposal was in the stages of final review.

Legislation for protecting H4 EAD rights raises new hopes for H4 workers

The midterm elections, which concluded recently in USA, have seen a power shift in favor of the Democrat party, who have reclaimed the majority in the House of Representatives have put forward a new legislation that seeks to prevent the US government under, Donald Trump’s Presidency from removing the authorisation to work of spouses and dependent partners of H1-B visa holders. The new legislation, if passed will be helpful to many H4 visa holders, including many Indians. The legislation was introduced in the Congress by two American lawmakers - Anna G Eshoo and Zoe Lofgren, who opined that discontinuing the work benefit would be counterproductive to US interests as eliminating it would force immigrant workers to compete against US business.

What are H-4 Visas

H-4 visas are visas that are issued to the spouses and dependent partners of foreign workers who arrived in USA on a H-1B visa, which is a non-immigrant visa that is used by workers to work in US companies. The visa allows US companies to employ worker, who are in specialty occupations and that cannot be filled by US citizens or residents on account of technical expertise that is required. Congressman Lofgren also added that the Trump administration’s agenda to prohibit H-1B dependent spouses from working would actually harm the country’s economy if allowed as many of the families who are currently living in USA and contributing to the US economy would choose to move to other countries that were more welcoming. The proposed bill intends to block the Trump administration from taking steps that would harm the Immigration to USA policy.

Persons living on H4 cannot be employed unless they have been granted EAD (Employment Authorization Document).
Persons living in USA on H4 are eligible to drive in USA and get a driver’s license
They can pursue education but only restricted to short term courses. For a long term course they will need to obtain a F1 visa which is otherwise called study visa USA
H4 visa holders can open bank accounts in their own name and file for a TIN (Tax Identification Number)
H4 visa holders cannot get a social security number (SSN), which can be identified for H1-B Visa Holders.

L2 Dependent Visa

The L2 dependent visa is issued to Dependent family members who accompany a L1 or intracompany transfer visa holder to USA.

Eligibility Criteria for L2 Visa Application

The spouse and dependent children of the primary applicant who are less than 21 years of age are eligible to accompany the primary applicant on a L2 visa.

Terms and Conditions applicable for L2 Visa process

The applicant can apply for L2 visa for his dependents along with his application for L1. Intracompany transfer visa. The following rules apply for persons staying in USA on a L2 visa.

Persons with L2 visa can undertake employment during their stay in USA.
Persons living in USA on L2 are permitted to drive provided with documents.
They can apply to convert their visa to other non immigrant visa types such as F1, B1, and L1.
They can open bank accounts in their own name and file for a TIN (Tax Identification Number) and social security number (SSN).
They can pursue higher studies during their stay in USA.

F2 Dependent Visa Process

The F2 dependent visa is granted to Dependent family members of students who are currently studying in USA on a F1 visa.

Terms and Conditions for F2 Visa holders

The F2 visa holder cannot seek employment during their stay in USA.
The F1 visa holder has to take care of all financial responsibility for the expenses incurred by the F2 visa holder.
The F2 visa holder cannot pursue full time study while living in the US.
