A recently conducted review of US
government has found that majority of the applications for employer sponsored
green cards have come from companies that have their headquarters in the United
States. Out of the list of top ten companies APPLYING FOR US IMMIGRATION on
behalf of their employees in the last six months, just two companies from
India, viz Infosys and Tata Consultancy Services were present.
US Based Companies Lead Applications for Green Cards
Technology companies based in
USA, such as Cisco, Facebook, Microsoft, Amazon, Cognizant, and Google have between
themselves filed more number of applications for green cards for their
employees from different countries. A major proportion of the beneficiaries of
these employer sponsored GREEN CARDS were Indians. Amazon
has filed more than 1,500 applications on behalf of its employees. NASSCOM, (National Association of Software
and Services Companies), has said that the report supports its claim that there
is a significant shortage of skilled workers in the United States and that companies
based in America are hiring more people from countries like India, where they
most of the skilled IT talent is available. The responsibility of applying for a green card rests with the
individual worker. However, many US based companies apply for an Immigrant
Petition for Alien Worker or I-140 in order to retain their highly skilled
resources.
Advantages
of Employer Based Green Cards for US Immigration
Employee based green cards are
processed on a fast track basis when compared to a family sponsored green card.
Especially at the senior management level, and if the company can prove with
the employee’s past track record, that the employee will need to travel multiple times to USA as part of his
work profile, then the green card can be processed under the 1st
preference category or EB-1 visa category. The APPLICATION FOR EB-1 VISA can take less than a year to process,
with some candidates obtaining their green cards in as less as nine months.
