More than 60 of the top ranked US universities, including such gems as Harvard and MIT, have filed a law suit challenging the stringent visa policy that was brought in by the Trump administration for students who study in USA.  The new visa rule called the 'backdating' rule is expected to have a detrimental effect on the higher education system of the country

What is the back-dating rule?

The back-dating rule is a new visa policy which was announced by the present US administration. It places new restrictions on students to prevent overstaying a visa.
To make things clearer, earlier, students who were not authorized to stay in the country on account of visa expiry would accrue their unlawful presence from the day the government issued an official statement that the visa was out of status. Anyone who stayed more than 6 months after being declared as un lawful would be forced to return to their home country and would be barred from entering USA for a period of three years.
However, according to the new back dating rule, the DHS (Department of Homeland Security) can be authorized to set retroactive start dates for determining unlawful presence which would start immediately the day after the student's degree program is completed or the day after the expiry of visa or the day after a person's visa expires.
Many of the top universities in USA, including Cornell, Yale, Harvard, MIT, and Princeton have come together to sign an amicus brief, contesting that the new rules were tough on the students and would be detrimental in the long run for the US education system.
